Guideline for intellectual property rights owned by SHIMA SEIKI MFG., LTD.
SHIMA SEIKI holds a large number of patents for a wide range of technologies, including "knitting technology," "mechanism and control of flat knitting machines," and "relevant design system" and the like as part of its intellectual property strategy. This is in order for our clients to use our products safely and securely.
However, SHIMA SEIKI has recently obtained information that some knitting companies may infringe SHIMA SEIKI's patents regarding knitting technology (hereinafter referred to as "the Knitting Technology Patents"). In countries where SHIMA SEIKI holds the patents, any use of the Knitting Technology Patents without SHIMA SEIKI's permission will constitute patent infringement. For knitting companies using SHIMA SEIKI's knitting machines, there is no risk of patent infringement because SHIMA SEIKI manages the licenses of the Knitting Technology Patents. This, however, does not apply to knitting companies using knitting machines of other companies, and SHIMA SEIKI is investigating and examining patent infringement in such cases. SHIMA SEIKI establishes such policy to take appropriate measures once SHIMA SEIKI confirms the infringement of its patents.
In addition, knitting programs (hereinafter referred to as "the Knitting Programs") that SHIMA SEIKI provides to its clients on its design systems and Users' Site web service are protected by copyright, in addition to its patent rights.
Further, since the Knitting Programs are provided on the assumption that the clients will use it with SHIMA SEIKI's products, their license agreement and terms of use prohibit, without SHIMA SEIKI's permission, the act of selling, transferring, or lending the Knitting Programs to any third party and any act of converting and using it for knitting machines of other companies (hereinafter collectively referred to as "Prohibited Activities") as an act that impairs SHIMA SEIKI’s interests.
Therefore, the Prohibited Activities are also considered as infringement of SHIMA SEIKI's intellectual property rights, and may be subject to liability including damages. Please take the necessary precautions when handling the Knitting Programs.
When using SHIMA SEIKI's design system and Users' Site, please also check the license agreement and the terms of use.
If there is any contact from any third party soliciting Prohibited Activities to our clients, or if there is any information that a third party is conducting Prohibited Activities, please contact us.
Finally, SHIMA SEIKI will continue to protect its intellectual property rights so that clients can use SHIMA SEIKI's products safely and with peace of mind. We appreciate your cooperation in this matter.
